Telephone Consumer Protection Act (TCPA)
If you have received unwarranted marketing calls from advertisers you may have a claim for money damages under the Telephone Consumer Protection Act (TCPA).
Telemarketing calls are made by advertisers that offer or market products or services to consumers. An "autodialer" call is a telephone call involving a live or pre-recorded message that can call telephone numbers using a random or sequential number generator. A "robocall" is a telephone call that uses an autodialer system to deliver a pre-recorded telemarketing message.
Prior express written consent is now needed for all autodialer and/or pre-recorded calls or text messages sent or made to a cell phone and pre-recorded calls made to a residential land line for marketing purposes.
The TCPA mandates statutory damages in the amount of $500.00 per call if placed unintentionally and $1,500.00 per call if placed intentionally.
